Terms for the Capsa landscape benchmark.
These terms explain how the benchmark works, what you can submit, and how Capsa may use benchmark data.

1. What these terms cover
These Benchmark Terms apply to the Capsa Intelligence landscape benchmark at benchmark.capsaintelligence.com and related benchmark emails or reports. If your company has a separate written agreement with Capsa, that agreement controls where it conflicts with these terms.
2. Who may use the benchmark
You may use the benchmark only if you are at least 18 years old and have authority to submit business information for your company. Do not submit personal, health, payment card, or highly sensitive employee information.
3. Your benchmark data
You keep ownership of the company information and benchmark inputs you submit. You give Capsa permission to use that information to operate the benchmark, prepare your comparison, improve Capsa products, contact you about benchmark results, and create aggregated or de-identified market insights.
Capsa will not intentionally disclose your identifiable company metrics to other benchmark participants without your permission. Peer comparisons are meant to be shared only when the data set is large enough to be useful and not identify a single participant.
4. Your responsibilities
- Submit information that you believe is accurate and that you are authorized to share.
- Keep your email access and verification codes secure.
- Use benchmark results as one input in business decisions, not as the only source of truth.
- Do not attempt to access another participant's account, data, or benchmark results.
5. Benchmark results are informational
Benchmark reports and comparisons are provided for general business information. They are not legal, tax, accounting, investment, employment, or financial advice, and they do not guarantee any business outcome.
6. Availability and changes
Capsa may update, pause, or discontinue the benchmark, change which metrics are collected, or decline submissions that appear inaccurate, unauthorized, abusive, or outside the intended landscape-industry use case.
7. Capsa materials
Capsa owns the benchmark application, report formats, analysis methods, software, design, and related materials. You may use benchmark results internally for your business, but you may not resell, publish, or repackage them as a competing benchmark service without written permission from Capsa.
8. Disclaimers and limits
The benchmark is provided as is and as available. To the extent allowed by law, Capsa disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the benchmark.
